This is an application for temporary bail in respect of the offence punishable under sections 465, 467, 468, 471, 419, 511, 420, 120B read with 34 of the Indian Penal Code, 1860 registered vide C.R. No.80 of 2023 with Shivaji Park police station, Mumbai. The applicant was arrested on 04/03/2023.

Learned APP requested for some time to take 1/3
instructions in the morning session. Hence, I have kept the matter in the afternoon session. However, instructions are awaited.

In this application, it is stated that elder brother of the applicant died yesterday i.e. on 14/12/2023. The funeral of deceased brother of the applicant is scheduled today i.e. on 15/12/2023 and 13th day ceremony is scheduled on 27/12/2023. In such a view of the matter, I am inclined to enlarge the applicant on humanitarian ground on temporary bail for a period of three weeks from the date of his release. Hence, the following order :-
O R D E R
(a) The application is allowed.
(b) The applicant- Anil Bhimrao Lakade in connection with C.R. No.80 of 2023 registered with Shivaji Park police station shall be released on temporary bail on his furnishing P.R. Bond of Rs.15,000/- with one or more sureties in the like amount.
(c) The applicant is permitted to furnish cash bail surety in the sum of Rs. 15,000/- in lieu of surety for three weeks. (d) The applicant shall surrender at the end of three weeks from his release.

(e) The applicant shall attend the investigating ofÏcer of Shivaji Park police station every Sunday between 11.00 a.m. and 1.00 p.m. during this period.
(f) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police OfÏcer. The applicant shall not tamper with evidence.
(g) On being released on bail, the applicant shall furnish his contact number and residential address to the investigating ofÏcer and shall keep him updated, in case there is any change.

The interim application is disposed of.
