By consent of the parties, this Writ Petition is disposed of, as the directions given by the Family Court, Mumbai in its order dated 9 August 2023 in item Nos.2 and 4 have now become infructuous. As regards item No.3 of the order dated 9 1/3
August 2023 which was regarding direction to the Wife to deposit the passport of the minor child in Court prior to 12 August 2023 has become infructuous. The parties hereby agree that they will co-operate with each other and if the Husband wants to travel with the minor child out of the country, the Wife will co-operate with such travel plans by signing any kind of forms required. The same arrangement will also apply to the Husband in case the Wife wants to travel with the minor child out of India.

Both the parties submit that the Interim Application for maintenance of the Wife and the minor child has already been filed by the Wife in the Family Court, Mumbai in the proceedings bearing Petition No.A-2648 of 2022. Ms.Kejriwal submits that even though no orders have been passed in it, such application has to be by way of moral duty of the Husband, he is paying around Rs.1,10,000/- per month towards the expenses of the minor daughter in the Bank account of the Wife and the school fees and bus fees are paid directly in the bank account of the School. She further submits that over and above these 2/3
payments, certain other payments are also being made by the Husband.

The Interim Application for maintenance pending before the Family Court, Mumbai is hereby expedited. The Husband has voluntarily agreed that he would like to deposit Rs.25,000/- per month in the bank account of the Wife as interim arrangement towards her ad-hoc maintenance, without prejudice to his rights and contentions.

The said voluntary statement made by the Husband is accepted by this Court.
