Ms.Mital, learned counsel for the applicant states that claim for compensation filed by the respondents before the MACT, Mumbai is rejected against the appellant and seeks liberty to withdraw this appeal. Statement is accepted.

First Appeal is dismissed as withdrawn in view of the aforesaid reasons. In view of dismissal of the First Appeal, civil application does not survive and is accordingly disposed of. Refund of Court Fees as per rules.

Office is directed to transmit Rs.25,000/- deposited by the appellant as and by way of statutory deposit to the MACT, Mumbai

The appellant is allowed to withdraw the amount deposited before the MACT, Mumbai pursuant to the interim order passed by this Court in view of the appellant having succeeded before the MACT, Mumbai.
