Heard learned Counsel for applicant, learned A.P.P. and learned Counsel for Intervener. Learned Counsel for complainant has tendered at bar affidavit of complainant duly signed by him along with the deed of settlement entered between applicant and complainant. Learned Counsel, in view of above development, has no objection if interim protection in force granted to applicant is confirmed. In that view of the matter, following order is passed :

ORDER

i) Interim order passed on 10.01.2019 stands confirmed with directions to applicant to attend Investigating Officer if called till filing of charge-sheet.

ii) Since applicant as well as complainant both are businessmen and on the basis of complaint lodged as police machinery is put in motion and investigation is in progress, application is allowed subject to payment of cost of Rs.10,000/- each payable by applicant and complainant regarding total amount of cost of Rs.20,000/- shall be deposited with the Registrar, Appellate Side, High Court, Bombay on or before 24.04.2019. On depositing the same, it shall be paid to Police Welfare Fund, Police Commissionerate, Nashik.

iii) Application is disposed of in above terms.
