P.C. :- 1] Heard learned counsel for the parties.

2] In clause 2(a) of order dated 24th April 2019, line 5, after the word "notice" add the following words "and papers".

3] Substitute clause 2(i) with the following clause:

"In case the application for recall of the order dated 22nd October 2018 is finally dismissed, then the learned Chief Metropolitan 1/2

DSS 503-wp-14517-18.doc Magistrate to issue appropriate direction with regard to amount of Rs.50 Lakhs with interest after affording an opportunity of hearing to all parties."

3] It is clarified that merely because the words "and papers" are permitted to be inserted in clause 2 (a) as aforesaid, the same does not mean that this Court has accepted the contention that papers were required to be served upon the petitioner. It is clarified that all such contentions on this issue are kept open for decision by the Chief Metropolitan Magistrate.

4] Necessary corrections to be carried out in the original order and upload the corrected order on the website.

5] Preaceip is disposed of accordingly.
