1] Parties have brought to my notice the order of Division Bench passed in Writ Petition No. 5337/2019 on 20/02/2020 thereby quashing and setting aside R.C.C. No. 1118/2017 which was pending on the fle of Judicial Magistrate First Class, Cantonment Court, Pune and also F.I.R. which has given rise to the aforesaid prosecution.

2] Parties hereto are at liberty to produces a certifed copy of the said order before the Magistrate. This Court expects the Magistrate to pass the consequential order pursuant to the order of the Division Bench and shall not insist on personal appearance of the parties before the Court. It shall be equally open to the respondent-husband to attend the said proceedings and follow necessary rituals in the light of aforesaid observations.
3] In the aforesaid background, prayer made by the applicant-wife for releasing amount of Rs. 3 Lakhs deposited in this Court towards one time alimony with accrued interest thereon is allowed. Registry is directed to forthwith transfer the said amount in the account of the applicant of which details are furnished by the learned counsel for the applicant viz:
