Heard the learned counsel for the applicant and the learned APP.
In this application for grant of regular bail, in Crime no. 321 of 2018 registered with Dattawadi Police Station, Pune for offence punishable under sections 366A, 376, 324, 504, 506 r/w 34 of the Indian Penal Code and sections 3 & 4 of the Protection of Children from Sexual Offences Act, 2012 applicant applicant was arrested on 31/08/2018.
2 22.3360.18 ba.doc The only role attributed to the applicant is that of physical presence of the applicant on the spot with one of the co-accused who played active role in crime in question.
The allegations against the applicant are too vague to infer any direct involvement.
Apart from above, from the record it appears that the complainant was away from home from 29/08/2018 till the date of complaint i.e. 31/08/2018, however, the family members have not lodged any missing complaint.
In the aforesaid background, it is really difficult to infer the direct involvement of the applicant. As such, in my opinion, applicant deserves to be released on bail. Hence, following order:
O R D E R
(I) Application is allowed.
(II) Applicant be released on bail in Crime no. 321 of 2018 registered with Dattawadi Police Station, Pune on furnishing P.R. bond in the sum of Rs. 25,000/- with

(III) Applicant shall not influence witneses or tamper with evidence.
Application stands disposed of.
