DATED : 26th JULY, 2022 P.C:- On 5/10/2018, application filed by the applicant to travel abroad was granted and he was permitted to travel as per his itinerary.

By way of security, he was directed to deposit a sum of Rs.One lakh in the Registry. Subject to the deposit of the amount, the EOW was directed to hand him over his passport so that he can travel abroad.

The learned counsel state that the applicant has accordingly travelled and returned back to the country. Tilak

2/2 9 IA 628-19.doc The learned counsel has also invited my attention to order dated 8/8/2019 passed in WP No. 4087/2016 when the subject FIR in which the applicant was arraigned as an accused, came to be quashed.

Against the said order, the complainant had approached the Hon'ble Supreme Court and on 18/2/2022, the parties have settled the dispute and entered into an agreement on 31/1/2022.

In the wake of the aforesaid development, and particularly, when the amount of Rs.One lakh was deposited as a security for the applicant being permitted to undertake the travel, and since he has returned back, the Registry shall permit the withdrawal of the said amount of Rs.One lakh, subject to the applicant establishing his identity before him. Application is allowed.
