Petitioners claim that they have purchased trust property in good faith from trustees who had communication from Court receiver that the Suit No.1526/2002 was dismissed. Later on it became clear that the office of Court Receiver has not sent any letter pointing out that the suit was dismissed. Said suit is still pending. Petitioners however do not point out any permission given by Joint Commissioner under section 36 of Bombay Trust Act permitting trustees to transfer the property. 2.
Apart from this, various disputed questions arise. We are therefore not inclined to intervene in extra ordinary jurisdiction. We keep all contentions of the petitioner open and dispose of the petition. No costs. (N. R. BORKAR, J.) (B. P. DHARMADHIKARI, J.)
