Learned Advocates representing both the sides jointly submitted that parties have settled the dispute and executed consent terms.

The consent terms executed by the petitioner and Respondent No.1 are tendered in Court. It is taken on record and marked as 'x' for identification. The petitioner and Respondent No.1 are present in the Court and they have confirmed execution of consent terms.

3.

As per consent terms the petitioner has agreed to pay Rs.5,00,000/- towards full and final settlement for dissolution of marriage with Respondent No.1. The petitioner handed over demand draft of Rs. 5,00,000/- to Respondent No.1. Both parties will not raise any claims against each other in future and no litigations will be filed against each other. As per clause-3 of the consent terms the Respondent No.1 had agreed to withdraw the proceedings initiated by her under the Protection of Women from Domestic Violence Act, which are pending before the Court of learned J.M.F.C., Bhor, Pune and all other complaint or proceedings.

Both the parties are ready to approach family Court, Pune for dissolution of marriage by mutual consent.

It is submitted that in view of consent terms Respondent No.1 has no objection for quashing the impugned proceedings and impugned orders in this petition.

Considering the aforesaid circumstances and in accordance with the consent terms this petition can be disposed of.

ORDER

i.

Criminal Writ Petition No.5805 of 2018 is allowed. ii.

The proceedings in Criminal M.A. No. 77 of 2014 pending before the Court of J.M.F.C., Bhor, Pune and the orders passed in the said proceedings which are subject matter of this petition are hereby quashed and set aside. iii.

Petition stand disposed of.
