In crime No.482/2017, the applicant who is in jail for last more than one year is seeking his release on bail. The contention is that the applicant is facing charge for offences punishable under section 307, 341 and 506 of the Indian Penal Code and sections 378(1) (3) of the Maharashtra Police Act, 1951 registered with Bhosari police station, Pune and he has already

Learned counsel for the applicant would then urge that no further custodial detention of the applicant is warranted. 4.

Perused the statements of the eye witnesses to the incident. The statements under section 164 of the Criminal Procedure Code of the victim and the complainant i.e. her husband in categorical terms speak of involvement of the applicant in a serious crime. The weapon used in the commission of crime is also recovered from the applicant.

As investigation depicts prima facie case against the applicant, the application in my opinion, does not warrant any consideration. The application, as such stands rejected. 6.

The Court below need not be influenced by the above observations during the trial.
