Heard learned counsel for the parties.

This is the second bail application preferred by the applicant. The first bail application preferred by the applicant was rejected on merits, by this Court (Coram : Revati Mohite Dere, J.) vide order dated 5th March, 2018, passed in Bail Application No.65 of 2018. However, the trial of the Applicant was expedited.

Learned APP, on instructions, makes a statement that charge
2/2 901-ba.3387.2018.doc has been framed in the said case and that two witnesses have been issued witness summons for today.

Since the trial has commenced, the present Application need not be entertained. In any case, the first bail application was rejected on merits on 5th March, 2018 and there is no change of circumstance warranting enlargement of the Applicant on bail. 5.
Accordingly, the application for bail is rejected and disposed of as such.

The learned Judge to dispose of the case, as expeditiously as possible, on its own merits, in accordance with law, uninfluenced by the observations made in either of the Bail Applications. REVATI MOHITE DERE, J.
