By this application, the applicants seek recall of the order Rajeshri Aher

2 5 ia 4770 of 2023.doc dated 4th December 2023, by which the aforesaid petition i.e. Criminal Writ Petition No.2696 of 2011, came to be dismissed for nonprosecution and in view of dismissal of Writ Petition No.2696 of 2011, Writ Petition No.3622 of 2011 also came to be disposed of, since it did not survive.

For the reasons set out in the application, the order dated 4th December 2023 is recalled, and both the aforesaid Writ Petitions are restored back to its original file.

Interim Application is disposed of in the aforesaid terms. Both the Writ Petitions i.e. Writ Petition Nos.2696 of 2011 and Writ Petition No.3622 of 2011 to be listed at its appropriate place for final hearing.
