IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION WRIT PETITION NO. 16136 OF 2023 Prabhjit Kaur Bamhra alias Prabhjit Kaur Dhandhyal ... Petitioner.

Versus

--- CORAM : SHARMILA U. DESHMUKH, J.

DATE : DECEMBER 22, 2023.

P. C.:

1.

By consent the learned counsel for the parties agree that the Respondent-father will have temporary access of the child for a period of three days i.e. from 26th December, 2023 to 28th December, 2023, during the Christmas vacation as directed by the Family Court. The parties further agree that as the Respondentfather is residing in Nashik and the Petitioner-mother is residing in Mumbai, during the period of access of three days, the respondent-father will make arrangement for the stay of the Petitioner in a hotel in the vicinity of the Respondent's residence

sa_mandawgad 916wp16136-23 at Nashik for a period of three days. The family members of the Petitioner-mother can reside in the hotel alongwith the Petitioner of three days.

2.

The parties further agree that during the period of access, the petitioner-mother can have the video-call access of the child so that the child also feel secure. It is, however, clarified that there should not be unnecessary video-calls which would result in hampering the access of the child. The Petitioner-mother needs to be sensitive to the fact that the continuous video-calls would result in the child wanting to go back to the mother, which would frustrate the whole object of giving temporary access to the father. The parties further agree that as the child is aged about 5 and 1⁄2 years, in event, there is an issue about the child needing the mother at night, appropriate arrangement to be made by the father to drop the child with the mother and the next morning the father can pick-up the child again for the purpose of access. 3.

Petition is disposed of in the above terms.
