On 12th October 2022, this Court passed following order: "1. According to the advocate for respondent no.2, the Petition involving similar issues between the same parties and co-accused has been rejected by this Court, and therefore, according to him similar order needs to be passed.

2. The advocate for respondent no.2 states that he has given notice of today'

s date to the advocate for the application but advocate is absent.

3. In that view of the matter, as and by way of last chance, Criminal Application is kept for disposal on 11th November 2022, "High on Board".

4. It is made clear that if the advocate for the applicant remains absent on the said date, the Application shall be decided on merits."

In spite of the said order, learned advocate for the applicant is absent. It appears that the applicant is not interested in prosecution with the criminal application.

The criminal application is dismissed for non-prosecution. No costs.
