1] Learned counsel for the Applicant submits that the matter is already settled between the parties. However, for non removal of the office objection and for supply of the copies of the Appeal Memo for service of notice on the Respondent, the Appeal came to be dismissed for default and hence, immediately after the Applicant got knowledge of the same, this Application for restoration of the Appeal was filed. 2] Considering the cause given and the submission that the matter is amicably settled between the parties, this Application is allowed by condoning the delay. The order of dismissal of the Appeal for non removal of the office objections is set-aside and the Appeal is restored to its original file.
3] The Appeal be placed before the Lok-Adalat.
