The Applicant is seeking regular bail in Crime No. 39 of 2018 for an offence punishable under Section 302 read with Section 34 of the Indian Penal Code. The Applicant is arrested on 7th February 2018 and after investigation came to be chargesheeted. 2.

The case of the prosecution is, the present Applicant along with co-accused murdered their fellow student namely, Mahesh Karande over the differences on very trifle issue.

There are statements of the witnesses who were present in the school, viz - Dnyaneshwar Jyotiram Dadas, Rohit Prakash Sathe, Navnath Arjun Shendge and Raosaheb Mansing Shinde wherein it can be inferred that at the time of incident the Applicant was present in the school with co-accused and was last seen in the company of the deceased Mahesh. The evidence also speaks that the Applicant was also custodian of the key of the room where the deceased was found murdered. There is strong circumstantial evidence to connect the Applicant with the crime in question.

Apart from above, the Applicant during his production before the Court appears to have threatened one of the witness for which NC is registered.

In view of above, no case for bail is made out. Hence, the Criminal Bail Application stands rejected.
