Learned counsel for the respondent no.2 invited my attention to the order dated 19/4/2021 passed by the Hon'ble Supreme Court in a challenge by the applicant to the order dated 5/3/2021 passed by this Court in Criminal 1/3
Appeal No.676/2019.

In this view of the matter, it is obvious that Interim Application No.4400/2023 and Interim Application No.4738/2023 are filed inadvertently.

Learned counsel for the applicant seeks leave to withdraw these interim applications.

Interim Application No.4400/2023 and Interim Application No.4738/2023 stand withdrawn.
CRIMINAL APPEAL NO.676/2019 5.
Learned counsel for the respondent no.2 appointed by the Legal Services Authority and on taking instructions from the respondent no.2 submits that the respondent no.2 will have no objection if Criminal Appeal No.676/2019 is allowed subject to some suggestions which have been put across to the appellants and if they are willing to accept the same. This is without prejudice to the contentions of the parties. 6.
During the pendency of the trial, the appellant no.1 has died. So far as the appellant no.1, the criminal appeal does not survive.

take instructions to respond to the suggestions made by learned counsel for the respondent no.2.
