By this application, applicant is seeking condonation of delay of 35 days in preferring the appeal against judgment and award dated 6th July 2018 passed by Motor Accident Claims Tribunal, Satara in M. A. C. P. No. 257 of 2011.

Learned counsel for the applicant draws the attention of this Court to paragraph no. 4 of the application to explain the delay caused. Learned counsel for respondents no. 1 to 3 has no objection, if the delay is condoned.

It is observed from the Registry notes that respondent no.4 though served has neither filed any affidavit in reply to the application nor is represented today.

Having heard the learned counsel present before this Court and having perused the reasons for the delay as set out in the paragraph no. 4 of the application, this Court is inclined to allow the application and condone the delay of 35 days in preferring the appeal. 6.

Delay of 35 days is hereby condoned. Civil application is accordingly disposed.

List the first appeal on 11th October 2021.
