The Applicant has taken out the present Anticipatory Bail Application, since he is apprehending arrest in connection with CR No.623 of 2018 registered with Baramati Police Station for the offences punishable under Sections 363, 366, 376(3) of the Indian Penal Code and under Sections 4, 8, 17 of the The Protection of Children from Sexual Offences (POCSO) Act, 2012.

The role attributed by the present Applicant in the complaint is that he assisted the couple to reside at Urali Kanchan and he is therefore charged with the harbouring the accused. The FIR do not disclose his name and the allegations are levelled against the other accused persons who is responsible for abducting and kidnapping the minor girl, who is 16 years of age.

In the peculiar facts, since the role attributed to the Applicant do not disclose that he had participated in the act of kidnapping or the alleged offence of the POSCO Act, I am inclined to grant the present application and pass the following order.

Order i) The Application for anticipatory bail is allowed. ii) In the event of arrest of the Applicant in CR No.623 of 2018 registered with Baramati Taluka Police Station for the offence punishable under Section 363, 366, 376 of IPC and under Section 4, 8, 17 of the POSCO Act, be released on P.R. Bond for Rs.25,000/- with one or more sureties of like amount.

3/3 919-aba-2706-2018.doc iii) The Applicant is directed to appear before Investigating Officer at Baramati Taluka Police Station once in a week and on any other dates whenever called by the Investigating Officer for the purpose of investigation.

iv) The Applicant is directed to co-operate to the Investigating Officer.

v) The Applicant shall not directly or indirectly pressurize, threat to the informant and other witnesses.
