Heard. By this Civil Application, the Applicant seeks permission to withdraw 50% of the amount deposited by the Insurance Company in the Tribunal.

The learned counsel for the Applicant submits that in an accident which occurred on 04.12.2009, Applicant No.1 lost her husband. She submits that she has to maintain her two children who are taking education. Hence, she needs some amount.

Considering the submissions made by the learned counsel for the Applicant and Basavraj G Patil 1/2

29.785.19-caf.doc the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

Hence, the following order:

a) Applicant No.1 Veena Vidyadhar Kadu is permitted to withdraw 1/3 of the total amount of compensation with interest deposited by the Insurance Co. in the Tribunal, without furnishing any security, subject to outcome of the appeal.

b) The Tribunal is directed to invest the remaining amount in a fixed deposit of any Nationalized Bank, initially for a period of one year and same shall be renewed from time to time till further orders.

c) Liberty granted to the claimants to prefer an appropriate Application for withdrawal of further amount, if they so desire, which will be decided on its own merits d) Civil application stands disposed off accordingly.
