The application is filed seeking condonation of delay of 124 days occurred in filing the above appeal. By the impugned judgment and order, the Applicant is convicted for the offences punishable under sections 302, 376(2), 377 of the Indian Penal Code, 1860 and sections 4, 6 and 8 of the Protection of Children from Sexual Offences Act, 2012 and sentenced to death. 2.
Be that as it may, the Applicant in paragraph 4 of the application has given an explanation for delay. This explanation coupled with the fact that appeal arises from the judgment and order of conviction, in our view, is sufÏcient cause to condone the delay. In that view of the matter, we allow this application in patilsr 1 / 2
