Heard the learned counsel for the applicant and the learned APP.

Applicant is seeking regular bail in Crime No. 285/2017 registered with Indiranagar Police Station, Nashik for offence punishable under Sections 302 r/w 34 of the Indian Penal Code. After arrest on 16/10/2017 applicant came to be charge-sheeted. The weapon used in the commission of crime a blade cutter

2 15.3428.18 ba.doc stained with blood and so also clothes. Same were sent for Chemical analysis. The report of the analysis is inconclusive outcome. The case is based on last seen i.e. circumstantial evidence as is apparent from the contents of the complaint. However, only on the single statement of last seen, it will be difficult to order further detention of the applicant. A similar view is already expressed by this Court in Bail Application No. 3142 of 2018 in this very crime. That being so, applicant deserves to be released on bail. (A) Applicant be released on bail in Crime No. 285/2017 registered with Indiranagar Police Station, Nashik on executing P.R. bond in the sum of Rs. 25,000/- with one or more sureties in the like amount.

(B) Applicant shall not influence witnesses or tamper with evidence.

Application stands disposed of.
