Defendant Nos.1 and 2 have filed their affidavit of evidence in Suit No.1358 of 1989. The Plaintiff in Suit No.4290 of 1994, has also filed his affidavit of documents together with his compilation and affidavit of evidence in lieu of examination-in-chief. The Plaintiffs in Suit No.1358 of 1989, do not desire to prosecute the suit, as recorded in the orders passed by this Court on 7 January 2015 and 11 March 2015. The suit is, accordingly, dismissed as not pressed. In Suit No.1358 of 1989, there is counter-claim filed by Defendant Nos.1 and 2. As noted above, an affidavit of evidence has been filed by the Defendants along with the affidavit of documents and compilation. Place the counter-claim in Suit No. 1358 of 1989, namely, counterclaim (L) No.1190 of 2000 and Suit No.4290 of 1994, for marking of documents on 16 April 2015.
