Mr.Kapadia also states that after the order dated 20th January 2014 was passed, defendant no.2 expired and the legal heir of defendant no.2 has been brought on record as defendant no.2A. Mr.Kapadia further states that notice of motion with the affidavit in support has been served upon defendant no.2A as well but no affidavit in reply has been filed.
