Mr.Vakil for defendant no.3 states that they were dropped in 1989 itself and this is stated in one of the affidavit filed by plaintiff. Mr.Vakil states that this should have been brought to the notice of the court by Mr.Jaiswal who has been appearing for plaintiff all the while. 2.

Mr.Jaiswal appearing for plaintiff states that cost that was directed to be paid on 5.10.2018 has not been paid because his clients have not responded. When the court asked Mr.Jaiswal as to why suit should not be dismissed for non compliance with the directions of the court, Mr.Jaiswal stated he leaves it to the court. Therefore, Suit dismissed.
