Mr.Shroff states that defendant no.2 has vacated the suit premises as per the undertaking given in the order recorded on 22nd January 2019. Mr. Shroff, therefore, seeks leave to withdraw the suit. Suit dismissed as withdrawn.
Refund of court fees in accordance with rules. Court receiver stands discharged without passing of accounts. Mr. Shroff gives an undertaking on behalf of plaintiff to pay any charges of the court receiver, if outstanding, within two weeks of receiving a communication from the court receiver. Undertaking accepted. Court receiver to hand over possession to plaintiff. Notice of motion accordingly stand disposed.
