The present Chamber Order is taken out for restoration of Petition, dismissed by Order dated 26.09.2017 under the provision of O.S.Rule 986.

Heard Ld. Counsel for the Applicant.

Ld. Counsel for the Applicant made statement that captioned Petition is uncontested. Applicant was unable to pay court fees since at the relevant time he was residing in USA, therefore, Petition was dismissed. Ld. Counsel for Applicant submits that now Applicant is ready to pay court fees.

As this is uncontested Testamentary Petition, reason mentioned by the Applicant in Affidavit in Support needs to be accepted. Accordingly, Chamber Order is granted as prayed and signed separately. No order as to costs.

Applicant and/or his Advocate to remove office objections on the Petition and get the same numbered and regd.
