This Company Application is for leave under Section 446 of the Companies Act, 1956, to prosecute Suit No.1084 of 2011 pending in this Court, against the Company in liquidation and to bring the Official Liquidator on record. For the reasons stated in the affidavit in support of the Company Application, the Application is allowed in terms of prayer clause (a). There shall be no order as to costs. The amendment to the plaint shall be carried out within a period of two weeks from today. It is clarified that any decree that may be obtained by the Applicant in the pending suit shall be executed only after leave of the Company Court and with intimation to the Official Liquidator.
