Heard the learned counsel for the applicant. The Notice of Motion taken out by the applicant has been dismissed by the Prothonotary and Senior Master in exercise of power under Rule 986 of the Bombay High Court Original Side Rules.

In view of the averments made in the affidavit in support, a case for restoration is made out. Accordingly, the Notice of Motion is made absolute in terms of prayer clauses (a) and (b) subject to condition of the applicant removing all office objections in the Notice of Motion (L)No.247 of 2015 within a period of three weeks from today.
