The learned Advocate for the Petitioner has sought leave to withdraw the Testamentary Petition No.1074 of 2022 on the ground that the properties are situated outside the jurisdiction of this Court with liberty to file a fresh Testamentary Petition before the appropriate Court. 2.

Leave is granted. Testamentary Petition is disposed of as withdrawn with liberty as prayed.

Court fees are to be refunded in accordance with the Rules. For the purposes of Section 43 of the Maharashtra Court Fees Act and the 1/2

16-tp-1074-2022.doc proviso to that Section, today's date is the date of making a claim for repayment. The Prothonotary & Senior Master will issue a certificate for a refund of Court Fees computed according to the Rules. He will act on production of an authenticated copy of this order without requiring a separate application.
