This petition is filed for appointing the petitioner as a guardian of minor - Yash Mahesh Nagvekar, who was born on 7th January, 2000 to one Mahesh Manohar Nagvekar and Sushma Mahesh Nagvekar. Father of the minor expired on 19th July, 2004 and the mother of the minor expired on 17th March, 2010. After the death of the father, the minor was living with his mother and after the death of the mother, the minor started residing with the petitioner and his maternal grandmother, who is the mother of the petitioner.
The petitioner is working as a Laboratory Assistant with Thadumal Shahani Engineering College at Bandra (West), Mumbai and has been looking after the maintenance, welfare and education of the minor. It is stated that the paternal grandfather expired since filing of the petition. The maternal grandfather has also expired. Both the grandmothers, i.e., paternal as well as maternal, have filed consent affidavit, both dated
2/3 16th December, 2011 which are at Exhibit 'D' and 'E' to the petition. It is stated that there is no Will left behind by the parents of the minor and there are certain investments in the name of the parents of the minor. It is submitted that if the petitioner is appointed as guardian of the person and property of the minor without security, remuneration and royalty, it would ease in collecting all the amounts payable to the minor which have been invested by the parents of the minor. Mr. Gandhi, counsel for petitioner states that proclamation has been issued and undertakes to file affidavit of service within two weeks from today. Undertaking accepted.
Having considered the petition and having heard the counsel for petitioner, I find no impediment in granting the relief as sought. Therefore, the petitioner is appointed as guardian of the person and property of the minor - Yash Mahesh Nagvekar. The amounts mentioned in paragraph 8 of the petition to be paid over with accumulated interest to the Prothonorary and Senior Master, High Court, Bombay to the credit of the minor - Yash Mahesh Nagvekar. The Prothonotary and Senior Master to invest the same in a fixed deposit with nationalised bank for a period of one year from today.
