Heard both the parties.

Both the parties submit that the affidavits filed by way of evidence have been affirmed before the Associate. The Consent Terms are drawn between the parties, signed by the parties concerned and have been placed on record. The same are accepted. The parties are at New York and therefore, in the interest of justice, their presence can be dispensed with by this Court since the affidavits are affirmed before the Associate.

Dusane 2/2 901 ps1.2019.doc In view of this, the suit stands disposed of by granting prayer clauses (a) and (b), which read as follows : (a) that the marriage solemnized between Plaintiff no.1 and Plaintiff no.2 on 21st January 2006 at Jeejeebhoy Dadabhoy Agiary, Colaba, Mumbai be dissolved under Section 32-B of the Parsi Marriage and Divorce Act, 1936 and decree of divorce be passed in their favour;

(b) for orders in terms of Consent Terms marked as Exhibit "B" hereto.

The Notice of Motion stands disposed of as infructuous. The decree of divorce be drawn accordingly.
