This is a petition for leave under Clause XII of the Letters Patent. The suit is filed praying for damages. Although defendant No.1 is a company having its registered office at Kolkata and its branch office at Mumbai. Defendant/Respondent Nos.2, 3 and 5 are having their office at Kolkata. Defendant/respondent No.4 is also having his office at Mumbai. Case of the petitioner/plaintiff is that he was working at Mumbai in the office of defendant No.1 and that the defamatory allegations, subject matter of the suit, were made by the defendants and were circulated in Mumbai and other cities. Learned Counsel for the petitioner has drawn my attention to the relevant paragraphs contained in the plaint to point out that the part of cause of action has arisen within the jurisdiction of this Court. 3.

Having perused the averments as made in the leave petition and relevant paragraphs in the plaint, in my opinion, material part of cause of action has arisen at Mumbai within the jurisdiction of this Court, hence with the leave of this Court being granted under Clause XII of the Letters Patent, this Court would have jurisdiction to try and entertain this suit. 4.

Leave granted. The petition is accordingly allowed. [G.S. KULKARNI, J.]
