The Appellants - original Plaintiffs have filed this Appeal against the order passed in Notice of Motion No.3731 of 2007 taken out in the Suit, seeking appointment of Court Receiver. The learned Single Judge however, by the impugned order, refused to appoint the Court Receiver. Being aggrieved by the said order, the Appellants have filed this Appeal. We are told that the Suit is ready for hearing, pleadings are complete, issues are framed and the matter is placed VRD

APP24.08 for admission and denial of documents.

In our view, no useful purpose will be served now in deciding the Appeal. We therefore dispose of the Appeal. All contentions of the Appellants and the Respondents are kept open and the learned Single Judge is requested to expeditiously dispose of the Suit, if possible within six weeks from today. With this direction, the Appeal is disposed of. Interim order shall continue till the disposal of the Suit.
