The State Government has filed an affidavit of Shri Bansi Gawali, Additional Collector, Mumbai City. In paragraph-4 of the said affidavit, a specific stand is taken that the impugned order passed by the Appellate Authority is revisable under Rule 84 of the Maharashtra Minor Mineral Extraction (Development and Regulation) Rules, 2013 and the said remedy is available to the petitioner. In view of the statement on oath, the learned counsel appearing for the petitioner seeks permission to withdraw this petition with liberty to file a revision application. Accordingly, we dispose of the petition with liberty as prayed. All contentions on merits are kept open. If revision application is filed expeditiously, the revisional authority is bound to note that the present petition was filed in this Court on 17th March 2018 and the same remained pending till today.
