1. The Company Petition is dismissed as withdrawn.

2. Mr. Cyrus Ardeshir, Advocate, is hereby appointed as Arbitrator to adjudicate the disputes and differences between the parties.

3. All rights and contentions of the parties on merits, including the question of bar of limitation are expressly kept open, to be urged before the learned Arbitrator.

4. No order as to costs.
