The petitioners are the paternal uncle and aunt of the minor child Dhananjay Mahendra Kudtadkar. Both the parents of the minor child have expired. The petitioners have produced the birth certificate of a minor child and death certificates of his parents. The petitioners have also produced their identification documents. The petitioners have further produced a photocopy of the ration card showing the names of family members living together. 2.

It is seen that the parents of the minor child have expired. The father of the minor child Mahendra R Kudtadkar was working as Peon in BMC. The petitioners have produced certified records of his service. The minor is required to be given his death dues, PF, Pension, etc. The petitioners are fit and proper persons to be appointed guardians of the minor child for disbursement of the amount of the death dues of his father to him. 3.

Hence the Guardianship Petition is made absolute in terms of prayer 'b'. The petitioners shall open a separate pension account in

jsn GP No.6_2015 the name of the minor child showing them as guardian. The pension shall be paid to the credit of the said account. The petitioners shall use the said amount only for the education and maintenance of the minor child. The BMC shall pay all the other death dues including gratuity, PF, etc payable to the father of the minor child to the accounts officer of this Court. The accounts officer shall invest the said amount in fixed deposit in any nationalised bank until the minor attains majority. The quarterly interest of the fixed deposit shall be disbursed to the petitioners which shall be used by the petitioners only for the maintenance and education of the minor child. 4.

Guardianship Petition is disposed of accordingly. ( ROSHAN DALVI, J. )
