There was an order dated 27th April 2016 in favour of the Plaintiffs. This was recalled on the 1st Defendant's Advocates application on 29th April 2016. He pointed out that the Notice of Motion was wrongly listed on 27th April 2016 and that is why he was not present. I noted that Mr. Upadhyay readily accepted this. Irecalled the order and posted the Notice of Motion for hearing and final disposal in the week of 13th June 2016. 12th August 2016

The matter has reached today as also on a previous occasion, i.e., 25th July 2016. On that day, none was present for the Defendants. Even today, none for appears for the Defendants. The name of the 1st Defendant's Advocate, Mr. Manjit Singh Jolly, is correctly shown on board. This weekly list was published well in advance.

There is no reason to delay any further. There is no material placed by the 1st Defendant to alter the view I took earlier. For the reasons in the order dated 27th April 2016, the Notice of Motion is made absolute in terms of prayer clauses (a), (b) and (c) with no order as to costs.
