Heard learned Counsel for the parties.

It is agreed between the parties that the petition can be conveniently disposed of by sending the matter back to the Additional District Collector and Competent Authority for considering the case of the Petitioner afresh and in accordance with law. Accordingly, the impugned order dated 28 December 2015 is set aside and the matter is remanded to Additional District Collector and Competent Authority (Urban Land Ceiling) Brihanmumbai for a fresh decision in accordance with law. All rights and contentions of the parties on merits are kept open. In the event, an adverse order is passed against the Petitioner by the Additional District Collector and Competent Authority, effect shall not be given to it for a period of two weeks from the date of the communication of the order.
