On the plea that land bearing Survey No.109/A/1 corresponding CTS Nos.3-3A to 3A/15, as per the development plan has been reserved for a primary school plus a playground, the Petitioner seeks direction from this Court to compel the State of Maharashtra to decide application filed by the Petitioner for allotment of said land to establish a primary school and in the alternative to issue a direction that notice inviting tender be issued inviting offers from all eligible parties who are desirous of taking said land and to allot the land to the successful bidder. 2.

Suffice it to state if the Government land comes under reference for a particular purpose it does not mean that private entities would be entitled to the said land for the Government may use the said land for the purpose specified using its own fund. There is no vested rights in the Petitioner to seek that the land be allotted to a private individual. 1/2
