This is an application under Section 279 of the Companies Act, 1956, for leave to file a suit for recovery against the company namely M/s. Shree Venkatesh Steels Ltd. (in Liquidation) in the Debt Recovery Tribunal, Mumbai. The Official Liquidator has no objection for grant prayers in the application.

For the reasons stated in the affidavit in support of the application, application is allowed in terms of prayer clause (a).

It is needless to mention that the said leave is subject to period of limitation as prescribed under the Limitation Act and the contention of the limitation is expressly kept open for the adjudication of the concerned Court.
