On 15-01-2018 this Court passed the following order :
1. Stand over to 31-01-2018 at 3.00 p.m.
2. In the meantime, the Respondents shall except for three individuals i.e. Mr.Alok Kumar, Mr. Raghunandan Prasad and Mr. Anup Banerjee, who are undergoing treatment at the Tata Memorial Hospital and are allowed to occupy three rooms with their relative/s, in Summerland Guest House, shall not allow any individual to use and/or occupy any of the rooms in the Guest House.
3. The learned Advocate for the Respondent No.1 shall file his Affidavit on or before 25-01-2018.

The learned Advocate for Respondent No.1 states that Mr. Raghunandan Prasad and Mr. Anup Banerjee have already vacated the suit premises. Mr. Alok ssp 1/2
arbpl 55 of 2018 (905).sxw Kumar shall be vacating the suit premises within a period of 4-5 days. The statement is accepted.

The learned Advocate for the Respondent No.1 states that no business is being carried at the guest house in view of the order passed by the learned Arbitrator under Section 17 of the Act. He further states that he shall give inspection of all the documents listed in paragraph No.7 of the order passed by the learned Arbitrator dated 06-05-2017 to the Petitioner and his Advocate within a period of 15 days from today. The statements/undertakings are accepted. 4.
In view thereof, the learned Advocate for the Petitioner states that prayer (a) of the Petition is worked out and he is not pressing for prayer clauses (b), (c) and (d) of the Petition. The Arbitration Petition is accordingly disposed of. ( S.J.KATHAWALLA, J. ) ssp 2/2
