Mr. Shinde, learned counsel for the Applicant (Original Defendant No.2) submitted that the Applicant (Original Defendant No.2) would like to withdraw the present Interim Application with liberty to file a fresh application.

One Sardar Singh Abrol is the Constituted Attorney of Defendant No.2 and he has verified the said Interim Application which is an admitted position. Admittedly, there is no decree passed by any court of law. Mr. Shinde fairly submitted that he would like to rectify the factual errors in the application and place the proper status of the parties qua the suit premises and file a fresh application.
