At the hearing of the above Notice of Motion, which is filed by the original Respondent No.2, the parties have arrived at a settlement and have tendered the Consent Terms bearing today's date evidencing the said settlement.

The said Consent Terms have been signed on behalf of the Petitioner Society by its General Secretary Shri Harishchandra Rajaram Parab and by the Respondent No.2 himself who is personally present in Court. The said Consent Terms have also been signed by the learned Counsel Shri Rajesh B Parab who is instructed by M/s. Legal Juris on behalf of the Petitioner, and by the learned Counsel Shri Abhijeet Kandarkar on behalf of the Respondent No.2. lgc

(908) nmw-232.14 The learned counsel for the parties pray that the above Notice of Motion as also the above Writ Petition No.665 of 2013 be disposed of in terms of the said Consent Terms.

The General Secretary of the Petitioner Society Shri Harishchandra Rajaram Parab has produced his PAN Card bearing No.AFDPP9695Q, the learned counsel for the Petitioner Shri Rajesh B Jain also identifies him as being the General Secretary of the Petitioner Society. The General Secretary Shri Harishchandra Parab when put in the box and queried states that the Consent Terms are agreeable to the Petitioner Society and that he has signed the said Consent Terms of his own free will and volition pursuant to the authorization given to him by the Petitioner Society of his own free will and volition. The Respondent No.2 when put in the box and queried states like wise.

The said Consent Terms are taken on record and marked as "X" for identification. The undertaking mentioned in Clause 3 of the said Consent Terms is accepted. Both the above Notice of Motion as well as the Writ Petition stand disposed of in terms of the Consent Terms. Rule in the above Writ Petition to accordingly stand disposed of.
