Counsel for petitioner has nothing to show whether the petition has been served on respondent or not. It should be noted that on 24.12.2014, Company Registrar has passed an order directing petitioner to serve the petition and file affidavit of service on or before 16.1.2015 as per Rule 30 of Company Court Rules, 1959. There is nothing on record that petitioner has complied with this direction. Counsel also states that he has nothing in hand to even tell the court whether such an affidavit has been filed or not. In view thereof, we cannot go ahead with the matter today.

2. Stand over to 4.12.2017. If petitioner is unable to show that petitioner has filed the affidavit of service in compliance with the order dated 24.12.2014, because there is no such affidavit in the record & proceedings and file a true copy thereof with the Registry on or before 2.12.2017, the petition will stand dismissed without further reference to this court. If petitioner produces the affidavit or files a true copy through the advocate certifying as true copy, then the petition should be listed on 4.12.2017."

2/2 CP568.14-907 Counsel Mr.Kale for petitioner states that petition has not been served even after the said order was passed. The order dated 28.11.2017 was a self operating order and therefore, the petition has already stood dismissed on 2.12.2017.
