Ms. Shah, counsel for plaintiff states that the matter is settled and seeks leave to withdraw the suit. Ms. Shah further states that copy of Vimmi Dutta's script will be returned by plaintiff during the course of this week and if any photocopies have been made thereof, the same will be destroyed during the course of this week.

This statement is accepted as an undertaking being made on behalf of plaintiff. Ms. Shah states that plaintiff will maintain confidentiality with respect to the script of Vimmi Dutta, which is being returned as mentioned earlier.

Mr. Patil, counsel for defendant states that pursuant to order dated 22nd March, 2017, defendant has deposited a sum of Rs.8,50,000/- with the Prothonotary and Senior Master, High Court, Bombay. Mr. Patil has Gauri Gaekwad

2/2 25.SL-26-2017.doc no objection if the amount invested pursuant to order dated 22nd March, 2017 together with accumulated interest, if any, be paid over to plaintiff since plaintiff is unconditionally withdrawing the suit. Registry to pay over the amount together with accumulated interest to plaintiff.

Suit dismissed as withdrawn. Refund, if any of court fees in accordance with rules.
