The suit is dismissed as withdrawn, at the request of the Mr Shah, for the Plaintiffs and on instructions. 2.

The withdrawal is before any evidence was recorded in the Suit. Accordingly there will be a refund of Court fees in accordance with the Rules and the Maharashtra Court Fees Act. The date of this order will be the date of the claim for repayment within meaning of Section 43 of the Maharashtra Court Fees Act and its proviso. The Registry will issue a certificate at the earliest on production of an authenticated copy of this order.
