The learned counsel appearing for the appellant on instructions of the appellant seeks permission to withdraw this appeal with liberty to file appropriate proceedings before the Customs, Excise and Service Tax Appellate Tribunal, Western Zonal, Bench at Bombay. Appeal is accordingly dismissed as withdrawn with liberty as prayed. All contentions on merits are kept open.

Needless to add that the Tribunal will take a note of the fact that the present Appeal was filed on 18th January 2016 which remained pending till today.
