The 1st Defendant died in 2013. Her heirs are already on record being Plaintiff No. 1 and Defendant No. 2. 2.

The submission by Ms Behramkamdin on behalf of the Decree Holder is that notice under Order 21 Rule 22 of the Code of Civil Procedure 1908 should be dispensed with as sought in the 5th February 2018

Having regard to these circumstances I will allow the Judge's Order which is signed separately.
